Terms of service
1. Provider
The Pixie Pilot platform (pixiepilot.ai) and web design services are provided by APRO Pixels d.o.o., Mušenik 19, 2393 Črna na Koroškem, Slovenia ("provider", "we"). Contact: info@apropixels.com, +386 70 554 155.
2. Services
The provider offers the customer:
- design and build of a website or online store (design, setup, content entry, launch on the customer's domain),
- use of the Pixie Pilot platform: hosting, SSL certificate, backups, maintenance, access to the management interface and ordering changes by messaging the team,
- an included volume of changes in the monthly plan, with further changes charged according to the current price list.
The content and scope of each plan are defined in the price list on pixiepilot.ai, which forms part of these terms.
3. Order, preview and conclusion of the contract
The customer places an order via the platform or the enquiry form. The provider prepares a free preview of the website, which creates no obligation for the customer. The contract is concluded when the customer approves the preview ("Approve preview" in the platform or written confirmation by e-mail). Only then does the obligation to pay the build fee and the first monthly subscription arise.
4. Prices and payment
- All prices are stated excluding VAT unless explicitly stated otherwise.
- The build fee is charged once, upon approval of the preview.
- The monthly subscription is billed monthly, in advance or in arrears as set at activation, and covers hosting, maintenance, platform access and the included volume of changes.
- Changes exceeding the included monthly volume are charged at the same price list with no mark-up; the customer is informed of the estimate before the work is done.
- Payment is possible by card or by invoice with an 8-day payment term. In case of late payment the provider may, after prior notice, temporarily restrict access to the platform.
5. Term and cancellation
The subscription is concluded for an indefinite period with a monthly billing period. The customer may cancel at any time without notice period; the subscription remains valid until the end of the current billing period. Upon termination the provider takes the website offline and, on request, delivers an export of the customer's content (texts, images, products, orders) in a common electronic format within 30 days.
6. Customer obligations
- The customer supplies the content (texts, images, logo, company details) and warrants that they hold the necessary rights to it.
- The customer is responsible for the legality of the content on their website, the accuracy of their company details and the fulfilment of obligations towards their own customers (e.g. consumer law for online stores).
- The customer keeps platform credentials secure and notifies the provider immediately of any unauthorised use.
7. Intellectual property
The customer's content remains the customer's property. Designs, templates, the platform software and code remain the property of the provider; the customer obtains a non-exclusive right to use them for the duration of the subscription. Websites built on the platform carry a discreet "Powered by Pixie Pilot" credit in the footer.
8. Availability, maintenance and backups
The provider strives for uninterrupted operation but does not guarantee 100% availability. Maintenance that may cause short downtime is, as a rule, carried out outside business hours. Backups are made daily and kept for 30 days. Servers are located in the European Union.
9. Limitation of liability
The provider is not liable for indirect damage, lost profit or loss of data arising from the use or inability to use the service, except in cases of intent or gross negligence. The provider's total liability is limited to the amount paid by the customer for the service in the last 12 months.
10. Personal data
The processing of personal data is described in the Privacy policy. Where the provider processes personal data of the customer's own customers on the customer's behalf (e.g. orders, forms), it acts as a processor; the processing terms form part of this contract.
11. Changes to the terms
The provider may amend these terms. Changes affecting the customer's rights or costs are announced by e-mail at least 30 days before they take effect. If the customer does not agree, they may cancel the subscription before the changes take effect.
12. Disputes
Slovenian law applies. The parties will try to settle disputes amicably; otherwise the competent court in Slovenj Gradec, Slovenia, has jurisdiction. The provider does not recognise any out-of-court consumer dispute resolution body as competent.
